GENERAL.
Every order is accepted subject to these conditions. Nothing in our catalogue should be construed as an offer to sell. The sending or giving to us of an order constitutes an offer that we may or may not accept. The sending or giving to us of an order shall constitute agreement to and acceptance of all terms of business including but not limited to these conditions.
AVAILABILITY.
All goods are offered subject to availability. Customers requiring large quantities are advised to telephone/email before placing an order.
TRANSIT.
Goods are dispatched in good condition. Please notify us (and the carrier where appropriate) of any delay, or damage to the goods in transit. Provide details in writing within seven days of delivery. Liability is limited to the purchase value of the goods. We are not responsible for the goods after delivery and inspection.
PAYMENT.
Payment is strictly with order. Payment can be by PayPal or Cheque or Postal Order via post. Cheques should be made out in favour of CJS Ceramics Ltd cheques should be used to enable efficient reimbursement when necessary. In the event of any cheque being returned by the bank after presentation, or requiring re-presentation of it for payment; any bank charges incurred by us together with a handling charge shall be reimbursed to us by the buyer. Interest will also be charged at a rate of 2% per month or part thereof that payment is delayed.
COMPLAINTS.
These must be received in writing within seven days of receipt of goods. Goods may be replaced or monies reimbursed upon return of any defective item as requested. Return of goods for other reasons will not be possible after acceptance on delivery by the buyer.
FORCE MAJEURE.
We shall not be responsible for any delay in delivery or non-delivery of any goods or any part of them, caused by any act of God, action by any government, or any department of central government or any local authority; or any strike, lock-out, industrial action, civil commotion, breakdown of machinery or vehicle power failure, inclement weather, fire, failure or loss at sea, detention at sea or port or related or similar; act of war or terrorism, or any other event or contingency beyond our control.
If any of the goods shall be rendered unfit for delivery by reason of any of the above mentioned acts, events or contingencies; the contract insofar as it relates to such goods shall be deemed to be discharged without liability on our part.
ARBITRATION.
We shall be at liberty to require any dispute arising out of the contract or any question relating thereto to be referred to arbitration under the provisions of the Arbitration Acts 1950 and 1979 or any statutory modification or re-enactment thereof at the time being in force.
